1 Acceptance of Terms

By downloading, installing, or using the Sivo iOS application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Sivo ("we", "our", "us").

2 Service Description

Sivo is an AI-powered email management application that helps you organise your inbox. The App provides the following features:

• Automatic email classification into Tasks, Notifications, and Other categories
• AI-powered extraction of deadlines, action items, and calendar events from your emails
• AI-generated email summaries
• Built-in to-do list and calendar

Sivo processes emails that you voluntarily forward to your unique Sivo receiving address. We do not access your email account directly.

3 Eligibility

You must be at least 17 years of age to use the App. By using Sivo, you represent and warrant that you meet this age requirement. If you are under 17, you may not use the App under any circumstances.

4 Account Registration

To use Sivo, you must create an account using a valid email address. You are responsible for:

• Maintaining the security of your account credentials.
• All activities that occur under your account.
• Notifying us promptly of any unauthorised use of your account.

5 Acceptable Use

You agree to use Sivo only for lawful purposes and in accordance with these Terms. You agree not to:

• Forward emails containing illegal, harmful, threatening, abusive, or otherwise objectionable content.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
• Use automated scripts, bots, or other tools to send excessive requests to the service or abuse the API.
• Circumvent, disable, or interfere with any security or access-control features of the App.
• Use the App to process emails belonging to another person without their explicit consent.
• Resell, redistribute, or sublicense access to the App or its features.

6 AI-Generated Content

Sivo uses artificial intelligence (Anthropic's Claude) to classify emails, extract tasks, and generate summaries. You acknowledge that:

• AI-generated output (classifications, summaries, extracted tasks) may not always be accurate or complete.
• You should verify important deadlines, dates, and action items against the original email content.
• Sivo is not responsible for any consequences arising from inaccurate AI-generated content, including missed deadlines.

7 Subscriptions & Payments

Sivo offers a free tier with limited features and a paid Pro subscription with expanded capabilities. Subscriptions are managed through Apple's in-app purchase system.

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.
• Refunds are handled by Apple in accordance with their policies.

8 Service Availability

We strive to provide reliable service, but you acknowledge that:

• The App may experience downtime for maintenance, updates, or unforeseen technical issues.
• AI processing features depend on third-party services (Anthropic) and may occasionally be unavailable.
• We do not guarantee uninterrupted, error-free, or secure access to the App at all times.
• We may modify, update, or discontinue features at our discretion with reasonable notice.

9 Intellectual Property

The App, including its design, code, content, logos, and trademarks, is owned by Sivo and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

Your forwarded emails and personal data remain your property. By using the App, you grant us a limited licence to process your content solely for the purpose of providing the service.

10 Limitation of Liability

To the maximum extent permitted by applicable law (including the Australian Consumer Law):

• The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claim related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or AUD $50, whichever is greater.
• Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded by agreement.

11 Termination

You may stop using the App at any time by deleting your account through the App settings.

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our Privacy Policy.
• Your use of the App poses a security risk or disrupts the service for others.
• We are required to do so by law.

Upon termination, your right to use the App ceases immediately and your data will be deleted in accordance with our Privacy Policy.

12 Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you consent to the data practices described therein.

13 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you through the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

14 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
